Kirkland Represents EagleView in $125M Patent Infringement Award
Kirkland recently obtained a critical jury verdict for EagleView Technologies in patent litigation relating to EagleView’s aerial roof-measurement technologies. After less than two hours of deliberation, the jury unanimously found that EagleView’s patents were valid and that competitors Xactware and Verisk committed direct, indirect and willful infringement. The jury awarded EagleView $125 million in lost profits, with the possibility of additional damages due to willful infringement.

The U.S. District Court for the District of New Jersey subsequently issued a temporary restraining order preventing EagleView’s competitors from making or selling products related to the technologies in question. The following month, the court ruled that a permanent injunction should take effect immediately to protect EagleView’s IP and prevent further infringement. These victories, which follow numerous pre-trial wins since the litigation began in 2015, validate the strength and importance of EagleView’s patents and technology, enabling EagleView to better support existing customers and reclaim customers lost as a result of the infringement.
