Kirkland Obtains Jury Trial Victory and $16 Million in Damages for Client Dyson, Inc.

On June 11, 2018, Kirkland obtained a jury trial victory and $16 million in damages for its client, Dyson, Inc., against its vacuum competitor SharkNinja in the U.S. District Court for the Northern District of Illinois. Dyson, an innovative technology company, is the maker of Dyson-brand vacuums. In this dispute, filed in November 2014, Dyson challenged the advertising claim of its competitor, SharkNinja, who had advertised that its Shark Rotator Powered Lift-Away cleaned carpets better than Dyson’s “Best” vacuum, which at the time was the DC65. The parties litigated this matter for four years. After a 10-day trial, the jury unanimously found that Shark’s advertising was false and that Shark’s false advertising was willful.
